- Defendant knew of the controlled substance’s presence;
- Defendant knew it to be a controlled substance.
(Rideout v. Superior Court (1967) 67 Cal.2d 471) (People v. Rogers (1971) 5 Cal.3d 129).
Again, while prevalent in the inner cities, this drug has become so popular that people of all races, gender and class are buying this drug. It is know for the “euphoric” state that comes when smoking “crack” aka Crystal Meth.
Another popular drug is Ecstacy or “Molly”. People like this drug for after parties and even some of the famous rappers are known for using this drug which is also an aphrodisiac. It gives you energy to stay up all night partying and has become very popular with kids and adults for these purposes.
11379 is NOT A WOBBLER and is charged as a felony due to the dangers of the drug.****
However, 11377 is a straight possession and the legislature recently changed this crime (possession only) from a wobbler to a straight misdemeanor.
